Having seen the leave granted to the Municipal Accountant in charge, Cr. Matías Oscar Rodríguez, File No. 3575, starting from July 1, 2022, and,
 
CONSIDERING:
That in order not to affect the normal operation of the Office, it is necessary to cover the position of Accountant through the appointment of Cra. Salomón María Vanesa, DNI: 26,188,244, File No. 8004; and Municipal Sub-Accountant through the appointment of Cr. Diego Paolo Cutro, DNI 27,181,566, File No. 8022, from July 25, 2022, to August 4, 2022, inclusive.
That considering the responsibilities implied by the performance of the aforementioned positions, it is necessary to grant an exemption from the provisions of Article 2 of Decree No. 260/2001.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Provincial Law No. 10,027 - Municipal Regime - amended by Provincial Law No. 10,082, according to the consolidated text of Decree No. 4706/2012 of the Provincial Executive Branch.

ARTICLE 1.- Entrust the attention of the position of Municipal Accountant to Cra. Salomón María Vanesa, DNI: 26,188,244, File No. 8004, from July 25, 2022, to August 4, 2022, inclusive.
 
ARTICLE 2.- Entrust the attention of the position of Municipal Sub-Accountant to Cr. Diego Paolo Cutro, File No. 8022, without prejudice to his duties, from July 25, 2022, to August 4, 2022, inclusive.
 
ARTICLE 3.- Grant an exemption from the provisions of Article 2 of Decree No. 260/2001, for the reasons set forth in the preceding recitals.

HAVING SEEN that the Secretary of Urban Development, Architect MIREYA LILIANA LOPEZ BERNIS, National Identity Document No. 12,426,693, has returned to her duties as of today's date, and,
CONSIDERING:
That during her absence, the Undersecretary of Public Services, Mr. OSCAR ALBERTO SANTANA, National Identity Document No. 14,307,291, was in charge of the Secretariat of Urban Development, without prejudice to his duties.
That the issuance of the measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Article 107, Subsection u) of Law 10,027 and its amendment, Regime of the Municipalities of Entre Ríos.
Therefore,

HAVING SEEN that on 06/06/2022, Decree No. 732/2022 was issued, and,
CONSIDERING:
That the Municipal Accounting Office observes that the Recital of the aforementioned Decree erroneously details the number of clauses of the lease agreement, the correct number being 12 (twelve) clauses. Likewise, the budget item to which this expense is to be charged is not indicated, which is item 0.1.90.01.01.02.21.16 SOCIAL DEVELOPMENT.
That the issuance of the measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Article 107, subsections ñ), q), and u) of Law No. 10,027 and its amendment - Municipal Regime of Entre Ríos.
Therefore,
THE MUNICIPAL PRESIDENT
DECREES:
ARTICLE 1.- Rectify the Second Recital of Decree No. 732/2022, which shall read as follows: "That the lease term is established at thirty-six (36) months starting from 03/01/2022, consisting of 12 (twelve) clauses, where the obligations, terms, and scope of the aforementioned Agreement are established".
 
ARTICLE 2.- Rectify Article 3 of Decree No. 732/2022, which shall read as follows: "Charge the approved expense to item 0.1.90.01.01.02.21.16 SOCIAL DEVELOPMENT, and said expense must be classified under Subsection d), point 11) of Article 12 of Ordinance No. 34,698".
 
ARTICLE 3.- Maintain the other provisions set forth in Decree No. 732/2022 dated 06/06/2022, in accordance with what is expressed in the preceding recital.

SEEN:
The importance of the operation of the Municipal Loan Fund Mixed Economy Company as a credit and promotion agency for micro-enterprises, and
CONSIDERING:
That in this framework, it is pertinent to contribute to the consolidation and increase of its operations as far as possible.
That for such reason it is considered judicious to transfer to said entity the sum of ONE MILLION FIVE HUNDRED THOUSAND PESOS ($ 1,500,000.-) as an Irrevocable Contribution for Future Share Subscription.
That the Secretariat of Treasury and Public Finance has intervened within its competence.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Provincial Law No. 10,027 - Municipal Regime - amended by Provincial Law No. 10,082, according to the consolidated text of Decree No. 4706/12 of the Provincial Executive Power.-
Therefore,

ARTICLE 1.- Dispose to transfer to the Municipal Loan Fund Mixed Economy Society the sum of ONE MILLION FIVE HUNDRED THOUSAND PESOS ($ 1,500,000.-) as an Irrevocable Contribution for future share subscription, in accordance with what is expressed in the previous recital.

Having seen the provisions of Ordinances No. 37,530/21 and 37,531/21.
CONSIDERING:
That said Ordinances establish the creation of the functions and competencies of those who will act within the scope of the Secretariat of Treasury and Public Finance.
That in accordance with the assignment of tasks and competencies carried out to the Directorate of Financial Democratization and Digital Inclusion under the Secretariat of Treasury and Public Finance, it is necessary for the fulfillment thereof to proceed to fill said position.
That this Executive Department considers that Lic. Garbarino Leandro Pablo, DNI 31,069,018, is the person who meets the conditions and responsibility to perform said function.
That this measure is issued in the exercise of the powers conferred by the Municipal Executive Department by Article 107 of Law No. 10,027, amended by Law No. 10,082 - Regime of the Municipalities of Entre Ríos.-
Therefore,

ARTICLE 2.- For the purposes of its registration, forward to the Directorate of Human Resources, subsequently forward to the Directorate of Payroll for the purposes provided in Article 1.-

CONSIDERING:
That Mr. Jorge Oscar Berguñan, National Identity Document 28,832,106, requests this Honorable Deliberative Council that, by way of exception, he be authorized to perform the radio mobile service with his vehicle.
That said request for exception is motivated by the impossibility on the part of the applicant to comply with Art. 9, Subsection a) of Ordinance No. 34,958, given that his vehicle does not meet the age required by the described regulations.
That Art. 9 Subsection a) of Ordinance 34,958 establishes that vehicles incorporated into the radio mobile category “may not exceed five years of age,” setting a requirement that limits –in some cases– the employment possibility of the vehicle owners.
That likewise, the vehicle is authorized to circulate according to the Mandatory Technical Inspection (RTO) certificate, dated 06/15/2022, expiring on 06/15/2024, which is attached to the aforementioned administrative case file.
That due to what is stated above, it is necessary for this Deliberative Body to approve the request and grant, on an exceptional basis, the radio mobile license in favor of Mr. Jorge Oscar Berguñan for his vehicle, of which he is the owner, brand Chevrolet model Classic 4P LS., License Plate PEO 007 year 2015, Owner Jorge Oscar Berguñan, DNI 28,832,106, so that he may perform the radio mobile activity.
 
Therefore:

CONSIDERING:

That Art. 9 Subsection a) of Ordinance 34,958 establishes that vehicles incorporated into the radio mobile category “may not exceed five years of age,” setting a requirement that limits –in some cases– the employment possibility of the vehicle owners, this being his only income and support for his family.
That likewise, the vehicle is authorized to circulate according to the Mandatory Technical Inspection (RTO) certificate, carried out by the province of Santa Fe with expiration on 12/14/2023, which is attached to the aforementioned administrative case file.
That given the impossibility of Mr. Méndez to access a vehicle that meets the requirements included in the regulations, this Deliberative Body, in order to contemplate and understand the reality that the applicant is going through, is pleased to grant, on an exceptional basis, the authorization of his vehicle brand Volkswagen, model Trend 1.6, license plate AA 118 ZD, year 2016, owner Mr. Ángel Aníbal Méndez, so that he may perform the radio mobile activity.
