----------DECREE No. 647/2024.
Concordia, May 21, 2024
HAVING SEEN the Ordinance of the Honorable Deliberative Council processed through Administrative case file No. 27,990-SC, enacted on May 16, 2024, and submitted for consideration by the Municipal Executive Department and,
CONSIDERING:
That these proceedings reach the Municipal Executive Department in order to decide regarding the promulgation or not of the text of an Ordinance enacted by the Honorable Deliberative Council on May 16 of the current year, which aims to promote the conservation of the cadastral condition—for tax purposes and until its subdivision, sub-division, or block division occurs—of those properties that, under the previous applicable regulations, were considered sub-rural and that, as of the entry into force of Ordinance No. 38,104/2023 of the COUT, became part of the urban area of our city. Having clarified this, it must be said that although the noble spirit that evidently motivated the Councilors to express themselves in the sense described above is shared, a simple analysis of the wording of the text under study shows that it refers to an ordinance that is currently repealed.
That said situation inevitably leads to a conflict from a strictly legal point of view, in light of the provisions of Articles 5 and 7 of the Civil and Commercial Code of the Nation, which puts its formal validity in crisis and prevents this Municipal Executive Department from issuing the legal act of promulgation.
That the Directorate of Cadastre and Legal Affairs has taken the intervention within its competence.
That in view of the provision enacted by the Honorable Deliberative Council, it is the decision of this Municipal Executive Department to proceed with the veto of the Ordinance processed by Administrative case file No. 27,990-SC, enacted on May 16, 2024, given the reasons invoked and pointed out in the recitals of this Decree.
That the issuance of this measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Article 107 of Law 10,027, amended through Law No. 10,082—Organic Law of the Municipalities of Entre Ríos, according to the consolidated text of Decree No. 4706/12 of the Provincial Executive Branch.
Therefore,
THE MUNICIPAL PRESIDENT
DECREES:
ARTICLE 1.- Veto, for the reasons set forth in the recitals of this Decree, the Ordinance (Administrative case file No. 27,990-SC), enacted by the Honorable Deliberative Council on May 16, 2024, regarding the COUT modification.
ARTICLE 2.- Send a formal note to the Honorable Deliberative Council, attaching a copy of this Decree, for its knowledge and further effects.
ARTICLE 3.- Communicate, publish, register, and archive.-
Dr. FRANCISCO AZCUE
Municipal President
Dr. LUCIANO DELL’OLIO
Secretary of Government.
