HAVING SEEN the proceedings contained in internal administrative case file N°57 Letter "L"/2023, and;
 
CONSIDERING:
That on page 1, Agent Mireya Liliana LOPEZ BERNIS, D.N.I. N° 12.426.693, Personnel File N° 1885, submits her resignation from her position effective January 1st, 2024, to avail herself of the benefits of the Common Ordinary Retirement, granted by the Retirement and Pension Fund of Entre Ríos.
That on pages 2 and 2 verso, there is a copy of Resolution N° 005740, dated 09/15/2023, from the Retirement and Pension Fund of Entre Ríos, granting the benefit of Common Ordinary Retirement to Agent Mireya Liliana LOPEZ BERNIS.
That on page 4, the Payroll Liquidation Directorate communicates that the aforementioned agent currently has no active private attachments or pending ones.
That on page 5, the Person in Charge of Special Credit Debt Control communicates that Agent LOPEZ BERNIS, to date, has no registered debts regarding Special Credits (salary advance).
That on page 6, the Human Resources Directorate reports that Agent Mireya Liliana LOPEZ BERNIS, D.N.I. N° 12.426.693, Personnel File N° 1885, has been providing services in this Municipality since June 1st, 2003. She serves as monthly staff in category 24° of the Municipal Scale. Dependent on the Secretariat of Urban Development. Furthermore, it communicates that said agent would have pending 11 (eleven) days of leave from the year 2014, 25 (twenty-five) days of leave from the year 2015, 25 (twenty-five) days of leave from the year 2016, 25 (twenty-five) days of leave from the year 2017, 25 (twenty-five) days of leave from the year 2018, 25 (twenty-five) days of leave from the year 2019, 25 (twenty-five) days of leave from the year 2020, 25 (twenty-five) days of leave from the year 2021, 25 (twenty-five) days of leave from the year 2022 and 30 (thirty) proportional days of leave from the year 2023 and the retirement subsidy established in Article 77° Bis of Ordinance N° 11.275/49 of three basic salaries of category 20°. It also communicates that:
-Article 77° Bis of Ordinance N° 11.275/49 establishes: "In case of retirement, employees who prove the effective granting of the same, within a period of 90 (ninety) days from being granted, shall be entitled to a subsidy equivalent to three basic salaries corresponding to category 20°."
That on page 7, through Opinion N° 99/24 dated 01/15/2024, the Legal Affairs Directorate communicates: "... this Directorate has no objection to the acceptance of the Resignation ... That ... it understands that it is appropriate to grant the payment of the twenty-five (25) days of leave for the year 2022 and thirty (30) days for the year 2023 and the retirement subsidy established in article 77°, Bis of Ordinance N° 11.275/49 corresponding to three basic salaries of category 20°.".
That on page 8, there is Decree N° 1.855/2.023 dated 12/28/2.023.
That on page 9, there is a new intervention by the Human Resources Directorate, through which it makes known that Agent Mireya Liliana López Bernis, Personnel File N°1885, served as a political official from 12/16/2019 to 12/10/2.023.
That on page 10, the Legal and Technical Undersecretariat communicates: ... "That given the Opinion issued by the Legal Affairs Directorate on page 7, the provisions of Decree N° 1855/2023 and what was reported by the Head of the Administrative Department of the Human Resources Directorate on 01/18/2024.-
That this Undersecretariat shares the criterion held by the Legal Affairs Directorate regarding the appropriateness of accepting the Resignation of the agent in question and the Subsidy of art. 77 bis of Ordinance N° 11.275/49.-
However, I am of the opinion that the payment of the 25 days of leave for the year 2022 and 30 days for the year 2023 is not appropriate, considering the fact that the applicant did not perform effective tasks as an employee of this Municipality during those periods, which is an essential element for the enjoyment of such benefit, but rather her duties were carried out as an Official appointed by the Local Executive branch.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Article 107° of Law N° 10.027/11 and its amendment Law N° 10.082 -Municipal Regime of Entre Ríos. According to the Consolidated Text (T.O.) of Decree N° 4706/12 of the Provincial Executive Branch.
 
Therefore,
 
THE MUNICIPAL PRESIDENT
DECREES:
 
ARTICLE 1.- Accept, effective January 1st, 2.024, the resignation submitted by Agent Mireya Liliana LOPEZ BERNIS, D.N.I. N° 12.426.693, Personnel File N° 1885, to avail herself of the benefits of the Common Ordinary Retirement, granted by the Retirement and Pension Fund of Entre Ríos.
 
ARTICLE 2.- Order the payment of the retirement subsidy established in Article 77° Bis of Ordinance N° 11.275/49, corresponding to three basic salaries of category 20°, in favor of Agent Mireya Liliana LOPEZ BERNIS, D.N.I. N° 12.426.693, Personnel File N° 1885.
 
ARTICLE 3.- Notify, let the Human Resources Directorate take note, then pass to the Payroll Liquidation Directorate for its effects.
 
ARTICLE 4.- Communicate, publish, register, and, in due course, archive.

HAVING SEEN: That the Mayor, Dr. FRANCISCO AZCUÉ, must be absent from the city during the morning hours due to matters related to the Municipal Administration and,
 
CONSIDERING:
That it is considered pertinent to place the Secretary of Government and Finance, Dr. LUCIANO DELL' OLIO, in charge of the Presidency of the Municipal Executive Department.
That it is considered pertinent to place the Undersecretary of Finance, Cr. PABLO SEBASTIAN FERREYRA, in charge of the Secretariat of Government and Finance.
That consequently, it is appropriate to proceed with the issuance of this provision.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Article 107° of Law 10.027, amended by Law N° 10.082 -Organic Law of the Municipalities of Entre Ríos, according to the Consolidated Text (T.O.) of Decree N° 4706/12 of the Provincial Executive Branch.

WHEREAS the Municipal President, Dr. FRANCISCO AZCUÉ, has returned to his duties on this date in the morning hours and,

That the Secretary of Government and Finance, Dr. LUCIANO DELL'OLIO, was in charge of the Presidency of the Municipal Executive Department.
That this Decree will be countersigned by the Undersecretary of Finance, Cr. PABLO SEBASTIAN FERREYRA, in charge of the Secretariat of Government and Finance.
That consequently, it is appropriate to proceed with the issuance of this provision.
That the issuance of this measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Article 107 of Law 10.027, amended through Law No. 10.082-Organic Law of the Municipalities of Entre Ríos, according to the consolidated text of Decree No. 4706/12 of the Provincial Executive Power.

HAVING SEEN the need to have qualified personnel in the Secretariat of Urban Development and,
CONSIDERING:
That in that sense it is necessary to detach the Municipal Agent, Inés Araceli Durantini Villalba, National Identity Document N° 39.033.153, Personnel File N° 9.778, from the Honorable Deliberative Council of Concordia and assign her to the Undersecretariat of Environment of the Secretariat of Urban Development, for the development of tasks and functions inherent to the area.
That the intervening areas have provided their consent.
That in accordance with what has been expressed and by virtue of the need for the reallocation of human resources and to have qualified personnel in the Undersecretariat of Environment of the Secretariat of Urban Development, it is deemed pertinent to issue this provision.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Provincial Law No. 10.027 - Municipal Regime - amended by Law 10.082; according to the consolidated text of Decree No. 4706/12 of the Provincial Executive Power.

ARTICLE 1.- Remove Municipal Agent Inés Araceli Durantini Villalba, National Identity Document No. 39.033.153, Personnel File No. 9.778, from the Honorable Deliberative Council of Concordia and assign her to the Undersecretariat of Environment of the Secretariat of Urban Development, for the development of tasks and functions inherent to the area, effective as of today's date.
 
ARTICLE 2.- Establish that the transfer expenses of the aforementioned agent shall be charged to item 0.1.90.01.01.01 - Undersecretariat of Environment.
 
ARTICLE 3.- Forward to the Human Resources Directorate for their knowledge, registration, and notification; once completed, inform the Undersecretariat of Health of the Secretariat of Human Development and the Payroll Directorate for the purposes of her salary processing, and in due course, archive as a record in the agent's personnel file.
