Through the Consumer Defense Directorate of the Municipality of Concordia, during the year 2024, 94% of the cases presented were resolved, which, in economic terms, meant a recovery of 54 million pesos in favor of those who filed the claims.
This was achieved through satisfactory conciliations with providers of goods and services.
The highest percentage of claims filed corresponds to banking entities, mobile phone companies, appliance retailers, and financing companies.
The total amount of claims filed, in general terms, was more than 60 million pesos.
REQUIREMENTS TO FILE A CLAIM
To file a claim, it is suggested to visit the Consumer Defense office, located at Avellaneda 26, from Monday to Friday from 8 a.m. to 12 p.m., with photocopies of all documentation related to the claim (invoices or purchase receipts, warranty certificate, contract, budget, service order, etc.) and the claimant's DNI.
Attend with a note describing the problem in detail, with a clear and chronological account of the facts, data of the party/parties claimed against, evidence, and a detailed request.
In the event of meeting all formal requirements, the claim is accepted and an administrative case file number is generated, which begins its course for resolution.
The response time will depend on the complexity of the claim. In the event that it has been favorable, the resident is informed via a WhatsApp message or phone call for the finalization and closure of the case.
In the event of a negative response from the provider, a conciliation hearing must be requested, assisted by a legal professional from this office, summoning both parties so that the issue can be addressed.
When a provider refuses to fulfill their obligations or shows no willingness to resolve a claim, the user or consumer has two options:
Request an administrative process: This procedure seeks the imposition of a fine on the provider, the amount of which will be allocated to consumer education.
Go to court: File a lawsuit so that a judge orders the provider to fulfill the due service and/or pay for the damages that the consumer may have suffered.
VIRTUAL CLAIM SUBMISSION
This modality is available 24 hours a day and can be carried out through the Federal Single Window from: www.argentina.gob.ar/ defensadelconsumidor/ form
EXAMPLES OF CLAIMS
Below, the Consumer Defense Directorate shares some examples of the claims that can be made: Sale of defective products; after-sales warranty not honored; failure to comply with the contracted service in a timely manner, victim of mistreatment, misleading advertising, abusive practices, unauthorized debits or discounts; lack of information at the time of contracting, misleading advertising, abusive interest rates, among others.
There is also a special resolution for hyper-vulnerable consumers, which means that if you are in a situation of special vulnerability at the time of contracting goods or services, due to age, disability, socioeconomic level, lack of digital or financial education, among other factors, you have, among other specific measures: special protection, facilities for claims, and a fast track for claims related to health and prepaid medicine.
