The Municipality of Concordia informs the community that, within the framework of forming his government team, the mayor Francisco Azcué summoned professionals and residents of recognized trajectory, who accepted to join the public administration with the objective of contributing their experience and commitment to the development of the city.
In some cases, these are retired individuals who were appointed ad-honorem. In order to recognize the expenses inherent to their function, at the time of their incorporation, the Municipality applied an administrative criterion based on a legal interpretation considered reasonable.
Said concepts are settled through a specific code - called “Code 600” - created in the year 2016 by Decree Nº198/2016, which has been used by the municipality for more than 10 years.
This procedure was formalized through the corresponding decrees, published in the Official Gazette, guaranteeing total transparency.
From the municipal administration, it is maintained that there is no incompatibility between the receipt of a retirement pension and the appointment to an official position. This is because said function does not constitute employment under a dependent relationship, so the regime of incompatibilities provided for in Law Nº 8.732, which provides for the Retirement and Pension Regime for provincial and municipal personnel of Entre Ríos, is not applicable. Likewise, this criterion is in line with the interpretation held by the Governor, the highest representative of the Provincial Executive Branch, in Decree Nº 171/2025, in which it is categorically established that political officials do not fall under the notion of “employment”.
Given the recent intervention of the Retirement Fund and the existence of a different legal interpretation regarding the applied modality, the Municipality expresses its full willingness to adapt the procedure, if appropriate, in accordance with what the competent bodies determine.
“We always act in good faith, with transparency and with the sole objective of adding valuable people to the administration who contribute experience and commitment. If adjustments need to be made, we will make them, as we have always done,” expressed the mayor. And he added: “It is regrettable that this situation is used for political purposes to question the honorability of officials who have demonstrated, in their trajectory and performance, a clear commitment to the community.”
In that sense, the Executive, through a decree, ordered to leave without effect, as of April 1st, this way of settling the representation expenses granted to certain officials who do not receive remuneration for their position. The measure is adopted with the objective of providing certainty and predictability, safeguarding legal security and avoiding potential damages to the social security situation of those involved, in the context of the different existing interpretations of the current regulations.
Likewise, and while this adjustment is being implemented, the Municipality is analyzing administrative alternatives for the settlement of representation expenses, as well as the legal tools that allow for the continuity of the functions that these professionals have been performing in the administration.
Differences in interpretation in legal matters are common and are part of the functioning of the institutional system. In this sense, the Municipality respects the competencies of each body and values the existing control mechanisms.
