WHEREAS The need to have qualified personnel in the Human Resources Directorate, and,
 
CONSIDERING:
That in this regard, it is necessary to reassign the Municipal Agent, Mrs. Echeveste Alejandra Isabel, National Identity Document No. 29,956,502, personnel file No. 6747, from the Cadastre Directorate, under the Secretariat of Government and Treasury, and assign her to the Human Resources Directorate, under the Secretariat of Government and Treasury, for the development of tasks and functions inherent to the area.
That the Secretariat of Government and Treasury has granted approval for the requested transfer.
That in accordance with the above and by virtue of the need for the reallocation of human resources and to have qualified personnel in the, it is deemed appropriate to issue this provision.
That this measure is issued in the exercise of the powers conferred upon the Municipal Executive Department by Article 107, subsections b), h), ñ), q) and u) of Law 10.027, amended by Law 10.082 - Regime of Municipalities of the Province of Entre Ríos.

ARTICLE 1.- Reassign the Municipal Agent, Mrs. Echeveste Alejandra Isabel, National Identity Document No. 29,956,502, personnel file No. 6747, from the Cadastre Directorate and assign her to the Human Resources Directorate under the Secretariat of Government and Treasury, effective from the issuance of this Decree.
 
ARTICLE 2.- Include within the scope of the agreement signed in due course with the Human Resources personnel by Decree No. 1.277/2022, who performs functions in the Human Resources Directorate, assigning her 35%, as long as she performs the established functions and tasks. Effective March 1, 2024.
 
ARTICLE 3.- Establish that the transfer expenses of the aforementioned Agent shall be charged to item 0.1.90.01.01.01 - Treasury Secretariat.
 
ARTICLE 4.- Forward to the Human Resources Directorate for their knowledge, registration, and  notification, complying with notifying the Payroll Liquidation Directorate under the Secretariat of Government and Treasury for the purposes of her liquidation, and in due course, archive as a record in the personal file of the Agent Mrs. Echeveste Alejandra Isabel, National Identity Document No. 29,956,502, personnel file No. 6747.

WHEREAS Administrative case file 1339144 for a request for secondment submitted by the National Senate, and;
 
CONSIDERING:
That through Administrative case file No. 1339144, the National Senator, Edgardo Kueider, submits the present request for secondment of Mrs. María Andrea González, DNI 23,932,890, personnel file No. 5795, Municipal Agent.
That the aforementioned agent serves as monthly personnel category No. 11, providing service in the Municipality since 07/01/2014.
That for service reasons, it is necessary to accept the present request.
That it is the decision of this Municipal Executive Department, in accordance with the guidelines established by the Mayor, for this Government Administration, to proceed to issue the present provision.-
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive by Article 107, subsections q) and u) of Law 10.027 and its amendment - Regime of Municipalities of Entre Ríos.-

The content of Decree No. 280/2024, and;
 
CONSIDERING:
That the aforementioned Decree establishes the expansion of the Administrative, Organic, and Functional structure of the Secretariat of Human Development; creating 12 Zonal Departments and appointing the coordinators in charge of them.
That the Zonal Departments bring together more than one CDI, which makes it necessary to have auxiliary personnel to collaborate with the Zone coordinators, in order to assist them and optimize the operation and improve the control of resources.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Article 107 of Provincial Law No. 10.027 and its amendment Law No. 10.082 - Regime of Municipalities of Entre Ríos. According to T.O. Decree No. 4706/12 of the Provincial Executive Branch.

SEEN:
The need to consolidate the presence of the Municipal State on public roads as well as in parks and promenades intended for public use, with the aim of promoting better conditions of safety and urban coexistence through prevention, education, and strict compliance with municipal regulations, and;
 
CONSIDERING:
That the Municipal State has the powers and tools necessary to develop public policies aimed at maintaining citizen security.
That, Ordinance No. 37925 in its Art. 4, resolves the creation within the scope of the Directorate of Municipal Prevention and Security, which is the enforcement authority thereof, of a body of inspectors, which will be in charge of carrying out the control and oversight of compliance with what is provided therein.
That Ordinance 36025, which regulates personnel performing admission and permanence control tasks for the general public, in its Art 3) determines that the Secretariat of Government, through the Directorate of Citizen Prevention and Security, will be the enforcement authority thereof, and in turn, Ordinance 36569, in its Art. 12) establishes that the Secretariat of Government, through the Directorate of Municipal Prevention and Security, will be the enforcement authority.
That, due to the regulations in the detailed Ordinances, it becomes essential to have an active and operational body of inspectors of the Undersecretariat of Citizen Security, in order to carry out effective control and oversight of the infractions determined by the ordinances in question and any other that may be issued in the future, and that specifically determines that the Undersecretariat of Citizen Security be the enforcement authority.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Law 10027, and its amendment Law No. 10082 -Regime of Municipalities of Entre Ríos-.

HAVING REGARD TO the proceedings contained in Internal Administrative case files No. 1456 "D"/22, No. 1567 "D"/22, No. 1566 "D"/22, No. 1778 "D"/22, No. 1842 "D"/22, No. 2259 "D"/22, No. 2320/"D"22, No. 2073 /"D"122, No. 2074 "D"/22, No. 2075 "D"/22 , No. 2076 "D"/22, No. 2257 "D"/22, No. 2258 “D”/22, No. 2260 "D"/22, No. 2371 "D"/22 , No. 1500 "D"/23 and;
 
CONSIDERING:
That the referenced administrative case files contain documentation and reports regarding repeated absences from the workplace of the monthly-salaried agent Esteban Ernesto Yaya, File No. 5022, DNI 23.613.298, who, accordingly, has not attended his workplace to provide services for a period exceeding 15 (fifteen) business days, with the absences reported by the corresponding offices being unjustified.
That the Human Resources Directorate reports that the monthly-salaried agent Esteban Ernesto Yaya, File No. 5022, has been providing services in this Municipality since June 1, 2007, is listed as monthly-salaried personnel, category No. 13, reporting to the Secretariat of Government and Treasury - Directorate of Municipal Prevention and Security, and that his service record shows disciplinary sanctions.
That on page 10 of Internal Administrative case file No. 1500 "D" 2023, there is an intervention by the Human Resources Directorate detailing days deducted from the agent Esteban Ernesto Yaya, File No. 5022.
That by means of the notifications contained on page 4 of Internal Administrative case file No. 1566 "D" 2022, on page 11 of Internal Administrative case file No. 1778 "D" 2022, on page 5 of Internal Administrative case file No. 2259 "D" 2022, on page 7 of Internal Administrative case file No. 2076 "D" 2022, and on page 4 of Internal Administrative case file No. 2371 "D" 2022, the Human Resources Directorate formally requests the agent Esteban Ernesto Yaya to submit the corresponding defense within a period of 48 hours, with no defense having been submitted. That on page 12 of Internal Administrative case file No. 1500 "D" 2023, the Disciplinary Tribunal considers that: by virtue of the administrative elements provided, it would be appropriate to initiate an administrative summary proceeding against the municipal agent Esteban Ernesto Yaya, File No. 5022, for presumably not having attended his habitual workplace to provide services for a period exceeding 15 (fifteen) days in the year, conduct that would prima facie be covered by art. 16, subsections a) and d), and 31, subsection a) of Ordinance 11.275/49.
That on page 14 of Internal Administrative case file No. 1500 "D" 2023, there is Opinion No. 18871 2023 from the Directorate of Legal Affairs sharing the opinion and advising to issue the corresponding administrative act appointing Dr. Gisela A. Trentin as the summary proceeding instructor.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Provincial Law No. 10.027 - Municipal Regime - as amended by Provincial Law No. 10.082; according to the consolidated text of Decree No. 4706/12 of the Provincial Executive Branch.

ARTICLE 1.- Order the initiation of an Administrative Summary Proceeding against the monthly-salaried agent Esteban Ernesto Yaya, File No. 5022, DNI 23.613.298, reporting to the Secretariat of Government and Treasury, for presumably not having attended his workplace to provide services according to the absences verified by the Directorate of Prevention and Security, as per the reports contained in the administrative case files mentioned in the preamble of this document, considering the absences from the entry and/or exit logs of the Attendance Control System enabled for such purpose as a presumption of absence, namely: June 11, 12, 18, 19, 25, and 26, 2022; July 2, 3, 10, 16, 17, 23, 24, 30, and 31, 2022; August 6, 7, 13, 14, 20, 21, 27, and 28, 2022; September 3, 4, 10, 11, 17, and 18, 2022; October 1, 2, 8, 9, 15, 16, 22, 23, 29, and 30, 2022; November 5 and 6, 2022, and the months of February, March, April, May, and June 2023.
That his conduct "prima facie" could be covered and/or included within the provisions of art. 16, subsections a) and d) of the Staff Ordinance No. 11.275/49 and what is prescribed by the provisions of art. 31, subsection a) of the aforementioned Ordinance, and by virtue of the powers granted to the Municipal Executive Department by Art. 40 of the legal framework cited above.
 
ARTICLE 2.- Appoint Dr. Gisela A. Trentin, reporting to the Directorate of Legal Affairs, as the Summary Proceeding Instructor.
