The Municipality of Concordia dismissed the challenge to Decree No. 668/2026, which launched Public Tender No. 47/2026. The appellant, Rubén Darío Carruega, is a native of Colón and recently established residency in Concordia.
The Executive Department dismissed the motion for reconsideration filed against Decree No. 668/2026, which approved the bidding terms and called for Public Tender No. 47/2026 to contract the urban solid waste collection service for the city. The decision, adopted within the framework of Digital administrative case file No. 3401/2026 and External administrative case file No. 1,367,967, declared the motion formally inadmissible for being filed out of time and for failing to prove the invoked legal representation.
A motion filed out of time
The document was signed by Rubén Darío Carruega, who appeared on behalf of the firm "C.I.M.S.". According to the records incorporated into the administrative case file and the calculation of deadlines established by the applicable municipal regulations, the filing was made after the expiration of the term provided for formulating the challenge, including the grace period contemplated by the administrative procedure regime. Consequently, the Executive Department considered the motion formally untimely.
Without proving the invoked representation
In addition to the untimeliness, the Municipality considered that the legal representation invoked by the filer was not proven: Carruega did not present a power of attorney, bylaws, articles of incorporation, or any document proving the legal existence of C.I.M.S. or his authority to represent it.
Likewise, the ARCA and ATER records provided only identify Carruega himself and his personal CUIT, without proving the existence of the company he claims to represent.
The substance of the claim, also rejected
The Municipality also did not grant the request for suspension of the process nor the 45-day extension requested for the opening of bids, considering that no evidence of steering, discrimination, or impossibility to participate in the tender was provided.
Technical response to inquiries
In parallel, the Municipality sent a response note to C.I.M.S. with clarifications to more than 90 technical inquiries regarding the bidding terms, related to containers, final disposal site, certifications, personnel, and equipment—, although without recognizing his legal representation.
Carruega had already appeared recently in the Public Tender for waste collection in Villa Elisa, alleging supposed irregularities. He is a native of the city of Colón and established residency in Concordia a short time ago
