No. 10.493
HAVING SEEN:
Administrative case file No. 29.126-P; where Parish Priest Néstor José Toler requests the remission of debt regarding “Contribution for improvements” curb and gutter, and;
CONSIDERING:
That Fr. Néstor José Toler, Parish Priest of the “Ntra. Sra. Del Valle” Parish, located at 1330 Tala St. in the city of Concordia, on 04/27/2026, received a “NOTICE-FINAL WARNING CONTRIBUTION FOR IMPROVEMENTS” from the Revenue Directorate of the Municipality of Concordia, claiming a debt in the amount of $ 385,995.98 corresponding to Lot No. 4150 –INTIMATION No.: 252-SR.BISHOPRIC Concordia -PLAN No.: 17368-OBJECT: 112705-PARCEL ADDRESS: 1330 TALA-SECTION: 0-GROUP: 10-BLOCK: 1886-PARCEL: 2;
That on December 8, 1998, by virtue of the provisions of Canon 515&2, and given the demographic growth of Concordia, His Excellency, Monsignor Héctor S. Cardelli, erected the Ntra. Sra. Del Valle Parish;
That on December 18, 2020, by letters issued by Monsignor Luis Armando Collazuol, Bishop of Concordia, he appointed Fr. Néstor José Toler as parish priest;
That said Parish is part of the Diocese of Concordia of the Roman Catholic Apostolic Church, registered with the National Directorate of Catholic Worship under No. 40/2000, and is recognized as a Public entity and Public Welfare Entity, in accordance with articles 146 inc. C and 147 of the Civil and Commercial Code of the Nation;
That the debt claimed corresponds to the settlement of the “CURB AND GUTTER” public works project carried out on TALA St. No. 1330 between Rca. Del Paraguay and San Lorenzo Ave. in Concordia, in accordance with the provisions of Ordinance No. 33,075 of 11.15.2005, and the values set by Decree No. 953/2022;
That the property for which the debt for “CURB AND GUTTER” is claimed corresponds to the Ntra. Sra. Del Valle Parish, which has always been exempt from the payment of provincial taxes, real estate municipal taxes, and sanitary municipal taxes and contributions;
That the debt claimed is unpayable for the Parish, and as it has its own legal personality, and therefore, lacks the level of economic resources to settle said tribute;
That the “contribution for Improvements” is a tribute based on the principle of the benefit that the property owner obtains from the work carried out, which grants their asset a value or capital gain that it did not have before as a consequence of said work. And specifically, that benefit or capital gain is the basis of the tribute; but in the case of the Ntra. Sra. Del Valle Parish property, although the work is a material improvement, economically it does not constitute a benefit or capital gain that would cause the tribute, since the improvement is ZERO or NEUTRAL, as it will not give greater value to the property as a consequence of the church being destined for the universal common good art. 235 inc. f) in fine CCCN-and, consequently, they are out of commerce; they cannot be sold, donated, or transferred;
That the Ntra. Sra. Del Valle Parish, has always been embedded in the neighborhood, deploying in its evangelizing task the social promotion of the residents and workers in a network with the institutions of the surrounding neighborhoods;
That it is appropriate to cite as a precedent the debt forgiveness granted to the San Pedro Apóstol Parish under ordinance No. 37,803;
That with the foundations set forth above and given the nature of the asset that comprises the entry for which the payment of said contribution for improvements is claimed, the reality of which is that they do not provide any economic benefit, which is the basis for the tribute. And that this Deliberative Body understands and values the work of social promotion, support, and network work carried out by the Ntra. Sra. Del Valle parish in the community, thus justifying the forgiveness as a measure to promote a public good entity;
That the Deliberative Council, in the exercise of the powers granted by Law No. 10,027, amended by Law No. 10,082 and Ordinance No. 35,649, considers it pertinent to proceed to grant the forgiveness.
THEREFORE:
THE DELIBERATIVE COUNCIL OF Concordia
ENACTS THE FOLLOWING
RESOLUTION
ARTICLE 1°.- Grant the forgiveness of the debt regarding the Curb and Gutter Improvement Contribution, for Lot No. 4150 PLAN NO: 17368 -OBJECT: 112705 -PARCEL ADDRESS: TALA No. 1330 -SECTION: 0 -GROUP: 10 -BLOCK: 1886 -PARCEL: 2, corresponding to the property registered in the name of the Bishopric of Concordia, by virtue of the preceding considerations.
