---------- Concordia, July 2, 2026.
No. 10,434
SEEN:
The submission made by representatives of event halls, spaces intended for celebrations, and related activities in the city of Concordia, through which they request an institutional statement from this Deliberative Council regarding the scope and application of the National Executive Power Decree No. 765/2024, and;
CONSIDERING:
That through the submission contained in the referenced administrative case file, the sector representatives state the existence of dissimilar interpretations regarding the practical application of the National Executive Power Decree No. 765/2024, particularly in relation to the requirement for the payment of rights derived from public performance;
That the National Executive Power Decree No. 765/2024 introduced modifications to the regulations of the National Intellectual Property Law No. 11,723, redefining the scope of the concept of "public performance" and expressly establishing that the use of works developed in a private setting, of temporary occupation, with restricted access and reserved exclusively for guests, does not constitute public performance, as it does not configure communication to the public under the terms provided by current regulations;
That the purpose of said regulatory modification consists of delimiting with greater precision the cases covered by the copyright collection regime, differentiating those acts that possess a public character from those that, due to their characteristics, remain within the strictly private sphere;
That the persistence of contradictory interpretative criteria regarding the scope of said regulation generates legal uncertainty for event organizers, halls, hotels, and related establishments that carry out their activity in the city of Concordia, affecting the predictability necessary for the normal development of a lawful economic activity;
That the activity linked to the organization of social, cultural, and family events constitutes an important local economic engine, generating direct and indirect employment for numerous workers and contributing to the commercial, tourist, and gastronomic development of our city;
That legal certainty constitutes one of the essential pillars for the development of economic activities, favoring investment, job creation, and the growth of the different productive sectors;
That the regulation of the intellectual property regime constitutes a matter of federal competence, with its legislation corresponding to the National Congress and its regulation to the National Executive Power, which is why this Deliberative Council lacks the authority to modify, regulate, or adhere to the aforementioned legal regime;
That, without prejudice to this, this Deliberative Body, in the exercise of its representative function and as an institutional organ of local government, is fully empowered to express its position regarding the interpretation and practical application of national regulations when they directly affect economic activities carried out within the municipal territory and constitute a subject of consultation by representative sectors of the community;
That Article 123 of the National Constitution and the principles of municipal autonomy recognized by the Provincial Constitution legitimize local governments to promote conditions of certainty, predictability, and development for the economic activities carried out in their jurisdiction, without invading the competencies of other levels of government;
That consequently, it is appropriate to express the institutional interpretation of the Deliberative Council regarding the scope that should be recognized for the National Executive Power Decree No. 765/2024, in relation to private events held within the city of Concordia;
Therefore:
THE DELIBERATIVE COUNCIL OF Concordia
ENACTS THE FOLLOWING
RESOLUTION
ARTICLE 1°.- Express the agreement of this Deliberative Council with the scope of the National Executive Power Decree No. 765/2024, establishing that its provisions constitute the interpretative criterion that should be observed within the city of Concordia, in accordance with the grounds set forth herein.
ARTICLE 2°.- Communicate this to the petitioners and to whom it may concern.
ARTICLE 3.- Communicate, publish, register, and archive.
