N° 9.924
SEEN:
The elimination of the Compensatory Fund for Public Transport of the Interior, putting at total risk the provision of the urban public passenger transport service in the City of Concordia, as well as in the other cities of the interior of the country; and,
CONSIDERING:
That said measure deepens the severity of the situation experienced due to the current economic context, established by high inflation rates; fuel price increases and the suspension for two (2) months of the payment of national subsidies, factors that drastically impact the operating costs of the urban passenger transport service;
That it is imperative to implement alternative proposals to the different requirements of the users, maintaining as non-negotiable principles the role of the Municipal State as controller of the service provision and guarantor of the rights of the users, to strive for the provision of a service in accordance with the needs of the citizenry;
That given the complexity of the new times and the sharpening of the different problems inherent to public passenger transport, a situation reflected in all cities of the country due to the historically inequitable distribution of national resources and their recent elimination; joint and articulated work between all actors in the system is fundamental;
That added to this is the increase in prices in the last months of the year 2023, impacting transport drastically through the increase in fuel, among other factors, also considering that this is an essential input for its operation;
That this has led municipal governments to begin adopting the necessary measures to sustain the transport service, as reflected by the Federal Network of Mayors, devising the necessary tools to activate the administrative and legal measures that make the claim for the restitution of subsidies viable;
That, as a consequence of the evident drop in revenue for companies and the difference in treatment that the Metropolitan Area of Buenos Aires has compared to the rest of the Argentine cities with the inequity in the distribution of National subsidies and their irregularity, it has led to companies being unable to comply in a timely manner with salary agreements, which has generated new industrial actions such as the partial or total interruption of the service by the UTA, directly causing harm to all users of the service in Concordia;
That faced with this situation, through Ordinance N° 38.239 dated February 7, 2024, the last bus fare increase for the City of Concordia was enacted;
That taking into account that the planning of the transport service provision must be guided by an eminently social criterion, prioritizing the interest of the user, given its public and essential nature, considering the demands and needs of the residents, as provided by Regulatory Ordinance N° 7833 “Urban Passenger Transport Service” and amendments;
That it is necessary, given the prevailing problem, to work to guarantee the sustainability and predictability in the provision of this public service that allows the accessibility of our residents to their workplaces, schools, and hospitals; therefore we must improve and protect it;
That the issue of mobility in general and public transport in particular must constitute a fundamental strategic objective for the government agenda of the City of Concordia;
That for this reason and faced with what has been previously stated, it is evident that the sustainability of the transport system, regulated by Regulatory Ordinance N° 7833 “Urban Passenger Transport Service” and amendments, is in crisis;
That this demands the implementation of immediate measures, so it is imperative to declare an emergency in this regard;
That for all the above, this Deliberative Body understands the need to request the Municipal Executive Department to declare the Emergency of the “Urban Passenger Transport Service” of the City of Concordia, for the period it deems pertinent;
That in the use of the powers granted by Law N° 10.027, amended by Law N° 10.082, and Ordinance N° 35.649;
Therefore:
THE DELIBERATIVE COUNCIL OF THE CITY OF CONCORDIA
ENACTS THE FOLLOWING
RESOLUTION
ARTICLE 1°.- Request the Municipal Executive Department to declare an Emergency for the “Urban Passenger Transport Service” of the City of Concordia, for the period it deems appropriate, by virtue of the preceding considerations.
ARTICLE 2°.- The Municipal Executive Department must adopt all necessary measures for the effective compliance with the Declaration of Emergency.
ARTICLE 3.- Invite the Deliberative Councils of the Province of Entre Ríos to adhere to the spirit of this Resolution.
ARTICLE 4.- Communicate, publish, register and archive.
