WHEREAS the Mayor, Dr. FRANCISCO AZCUÉ, has returned to his duties this afternoon, and,
 
CONSIDERING:
That the Vice Mayor, Mrs. MAGDALENA RETA URQUIZA, was in charge of the Presidency of the Municipal Executive Department.
That the Secretary of Government and Treasury, Dr. LUCIANO DELL'OLIO, will countersign this Decree.
That consequently, it is appropriate to proceed with the issuance of this provision.
That the issuance of this measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Article 107 of Law 10,027, as amended by Law No. 10,082 - Organic Law of the Municipalities of Entre Ríos, according to the consolidated text of Decree No. 4706/12 of the Provincial Executive Branch.

ARTICLE 1.- The Municipal Mayor, Dr. FRANCISCO AZCUÉ, is placed in possession of his office, on the current date in the afternoon.
 
ARTICLE 2.- The Vice Mayor, Mrs. MAGDALENA RETA URQUIZA, is reinstated to her functions and office, starting from the current date in the afternoon.

DECREE No. 083/2024

SEEN Provincial Law No. 10.027 - Municipal Regime - amended by Provincial Law No. 10.082; according to the Consolidated Text (T.O.) Decree No. 4706/12 of the Provincial Executive Power, and
 
CONSIDERING:
That Article No. 107 of the aforementioned Law establishes as an attribution of the Municipal Mayor, among others, that of executing the municipal budget.
That Article No. 109 establishes the possibility for the Executive Department to have one or more secretaries.
That for a correct execution of the municipal budget, the regulations of the Executive Department that provide for the realization of an expense must be countersigned by the secretary of the corresponding area.
That the municipality incurs periodic and continuous expenses over time that are necessary for the provision of public services under its jurisdiction, whose registration and payment cannot be delayed beyond the due date, due to reasons of economy and efficiency.
That for the aforementioned expenses, it is necessary that in the interventions of the regulations that recognize, approve, provide for, and/or register them, the intervention of the Municipal Mayor be considered sufficient, countersigned by the Secretaries of Government and Treasury and/or the Chief of Cabinet.
That the issuance of this measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Provincial Law No. 10.027 - Municipal Regime and its amendments.
 
Therefore,
 
THE MUNICIPAL PRESIDENT
DECREES:
 
ARTICLE 1.- It is provided that all regulations of the Municipal Executive Department that recognize, approve, provide for, and/or register expenses must be intervened by the Municipal Mayor; countersigned by the Chief of Cabinet and/or the Secretary of the corresponding area.
 
ARTICLE 2.- Except from the provisions of Article 1 of this Decree, the regulations that recognize, approve, provide for, and/or register periodic expenses corresponding to the consumption of electrical energy and its accessories, telephony in general, salaries and contributions, security services, natural gas supply, water supply, rental of photocopiers, internet services, cable TV services, goods and services acquired by the Directorate of Purchases and Supplies for various jurisdictions, as well as all those goods and services of a similar nature. For these special cases, only the intervention of the Municipal Mayor will be necessary, countersigned by the Secretaries of Government and Treasury and/or the Chief of Cabinet.
 
ARTICLE 3.- Decree No. 830/2013 and any regulation that opposes this provision are hereby repealed.
 
ARTICLE 4.- It is provided that this Decree will be countersigned by the Chief of Cabinet and all the Secretaries of the Executive Department.
 
ARTICLE 5.- Communicate, publish, register, send an authenticated copy of this Decree to the Municipal Accounting Office, and then archive it.

DECREE No. 084/2024

SEEN Resolution No. 204/2023 of the Administrative Commission of the Uruguay River and;
 
CONSIDERING:
That for such issues it is essential to expand the 2023 Budget, That this measure is issued in accordance with the provisions of Article No. 8 of the 2024 Budget Ordinance No. 38.231 which empowers the Municipal Executive Department to expand it due to new and greater revenues with specific allocation, with the condition of prior communication of carrying out such expansions to the Deliberative Council.
That the issuance of this measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Articles 107 of Law No. 10.027 - Regime of the Municipalities of Entre Ríos and its amendments.
 
Therefore,
 
THE MUNICIPAL PRESIDENT
DECREES:
 
ARTICLE 1.- Approve the modification to the General Budget of the Municipal Administration as provided in the following articles.
 
ARTICLE 2.- Expand the Calculation of Resources of the Municipal Administration corresponding to the 2024 Fiscal Year by the sum of FIFTEEN MILLION EIGHT HUNDRED TWENTY THOUSAND PESOS ($ 15,820,000) intended to cover the expenses set in Article 3 of this Decree.
 
ARTICLE 3.- Expand the General Budget of expenses for the 2024 Fiscal Year, in the budget item 0.4.90.01.03.04.34.20 "CARU CONTRIBUTION RES 204/23", of the Undersecretariat of Government Jurisdiction in the sum of FIFTEEN MILLION EIGHT HUNDRED TWENTY THOUSAND PESOS ($ 15,820,000).
 
ARTICLE 4.- Communicate to the Honorable Deliberative Council with a copy of this Decree, the use of the power of Article 8 of Ordinance 38.231.

DECREE No. 085/2024.

SEEN, the Type "B" Service Invoice 1326-01449127, presented by the firm CLARO AMX ARGENTINA S. A., with address at Av. de Mayo No. 878, Autonomous City of Bs. As, whose proceedings are in the administrative case file No. 1.339.023, and;
 
CONSIDERING:
That in the aforementioned administrative case file there are records sent by the aforementioned firm, corresponding to other charges and credits for the period of the month of December 2023 and other concepts of the month of November 2023.
That the Directorate of Electrotechnics and Communications has carried out the pertinent controls.
That the Municipal Accounting Office has taken the intervention of its competence and reported on the matter.
That the Directorate of Planning and Budget, on pages 42 and 43, has indicated the items corresponding to charge this expense, in the Preventive No. 105/2024.
That the Undersecretariat of Treasury authorizes said preventive on page 44.
That this expense falls under Art. 12, Subsection d2, of Ordinance No. 34.698.
That the issuance of the measure is carried out in the exercise of the powers conferred upon the Municipal Executive Department by Article 107, subsections ñ), q) and u), of Law 10.027 and its amendment - Regime of the Municipalities of Entre Ríos.
 
Therefore,

DECREES:
 
ARTICLE 1.- The continuation of the procedure for the invoice, found in administrative case file No. 1.339.023, is ordered, for the purposes of paying for the Service, corresponding to the period of the month of December 2023 and other concepts of the month of November 2023, of the Company CLARO AMX ARGENTINA S. A, according to the provisions of Article 113 of Ordinance No. 34.698.
 
ARTICLE 2.- Approve the present expenditure for the total sum of ONE MILLION SIX HUNDRED SIXTY-TWO THOUSAND FIFTY-NINE PESOS AND 69/100 ($ 1,662,059.69) as an exception to Decree No. 1391/05, corresponding to the period of the month of December 2023 and other concepts for the month of November 2023, and declare said amount as a legitimate payment to the company Claro AMX Argentina S. A., in accordance with the records contained in this administrative case file.
 
ARTICLE 3.- Charge the expenditure approved in Art. 2 to the items detailed in Annex I, which form an integral part of this Decree.  
 
ARTICLE 4.- Frame the present expenditure within Art. 12, Subsection d2), of Ordinance No. 34,698. If applicable, proceed in accordance with the provisions of Art. 115 of Ordinance No. 34698/11 and its amendments.
 
ARTICLE 5.- Remit to the Payroll Department for the purpose of proceeding to deduct from those responsible for the cell phones detailed on page 25, the respective spreadsheet with the details of their holders, what corresponds to each one, in accordance with what is detailed in the preceding considerations.
 
ARTICLE 6.- Forward to the Accounting Department and the Treasury for their purposes.
 
ARTICLE 7.- Communicate, publish, give to the Secretariat of Government and Treasury; and in due course, archive.

HAVING SEEN the proceedings contained in Internal administrative case file No. 1655 "S"/2023 and;
 
CONSIDERING:
That on page 1, the Monthly Agent LUIS ALBERTO SILVA D.N.I. No. 25,398,999, File No. 2218, submits his resignation from the position effective December 10, 2023, for personal reasons.
That on page 2, the Human Resources Department reports that Agent Silva Luis Alberto, File No. 2218, has provided services in this municipality since July 10, 1995. He serves as monthly personnel in Category 23 of the Municipal Scale. Dependent on the Secretariat of Urban Development, Directorate of Workshops and Warehouses. It also communicates that by Decree No. 441/2020, dated 04/06/2020, he was granted unpaid leave, provided for in Ordinance No. 23,784/88,
That on page 3, through Opinion No. 72/24, dated 01/04/2024, the Legal Affairs Department communicates that it has no legal objection to formulate.
That the issuance of this measure is carried out in the use of the powers conferred upon the Municipal Executive Department by Article 107 of Law No. 10,027/11 and its amending Law No. 10,082 - Regime of the Municipalities of Entre Ríos. According to the Consolidated Text of Decree No. 4706/12 of the Provincial Executive Power.

DECREE No. 087/2024

HAVING SEEN Decree No. 1,703/2023 and,
 
CONSIDERING:
That due to an involuntary error, leave days for Agent Martínez María Inés, file No. 15010, were omitted.
That the Payroll Department requests a new opinion, since the leave days do not coincide with those issued by the Human Resources Department.
That the Legal Affairs Department issues Opinion No. 98/24; that pending leave corresponds to (25) twenty-five days from the year 2021, (30) thirty days from the year 2022, and (25) twenty-five proportional days from the year 2023 according to the time worked. Regarding Art. 77 bis of Ordinance 11,275/49, it reiterates the opinion.
That the present measure is issued in the use of the powers conferred upon the Municipal Executive Department by Article 107, subsections b), h), ñ), q) and u) of Law No. 10,027, amended by Law No. 10,082 - Regime of the Municipalities of the Province of Entre Ríos.-

DECREES:
 
ARTICLE 1.- Modify Article 2 of Decree No. 1,703/23, which shall read as follows: "ARTICLE 2.- Order the liquidation and payment to the former Municipal Agent Martínez María Inés, file No. 15010, of 25 (twenty-five) days of leave from the year 2021, (30) thirty days from the year 2022, and (25) twenty-five proportional days from the year 2023 and proportional Christmas bonus for the second semester of the year 2023 according to the time worked and the subsidy established in article 77, Bis of Ordinance No. 11,275-49 corresponding to (3) three basic salaries of category 20, in full agreement with what was dictated by the Legal Affairs Department and the Human Resources Department, whose records are contained in Internal administrative case file No. 67 M"/23.
 
ARTICLE 2.- Maintain the remaining content of Decree 1,703/23 in full force.
 
ARTICLE 3.- Communicate, publish, register and archive.
